Gibson Medical (”Gibson”) appreciated your interest in our products and that you visit our website, www.gibsonmedical.se ( the ”website”). Your integrity is of importance to us and we want to inform you of our privacy commitment. Gibson Medical will always comply with applicable law on privacy, amongst others the general data protection regulation (so-called GDPR), the Swedish Personal Data Act and other applicable privacy laws.

We collect personal data when you provide us with information on the website, communicates with us via e-mail or in any other way are in contact with us that leads to that personal data is handled and processed. Examples of situations are:

This is how we use the collected information

We collect, store and use your personal data to be able to respond to your requests and questions (either via mail, e-mail or phone), to provide you with information especially requested by you, to contact you in connection with a privacy request, to improve our services and products and/or for business development purposes. In addition, we process your personal data in order to keep you up to date on your areas of interest (e.g. via newsletters), for our legitimate business interests, to be able to fulfil our legal requirements and/or in accordance with what is other authorised by law. If you have applied for a position at Gibson Medical, and thus shared your personal data with us, Gibson Medical will process your personal data to consider your application. We will provide you with more information on our processing of applicants’ personal data when receiving your application.

How long do we store your personal data?

Gibson Medical will store your personal data as long as (i) they are necessary to fulfil the identified purposes that they are processed for, (ii) it is required by law or (iii) it is needed to establish, exercise or defence legal claims or whenever courts are acting in their judicial capacity. In respect to your contact details, we will store these as long as we are in regular contact with you. If you have not been in contact with us for four (4) consistent years, we will delete your contact details.

The contents of your messages or your privacy request to Gibson Medical will be stored for two years in its full form. After two years, we will anonymise the personal details and keep the message in anonymised form for statistical purposes.

How we protect the collected data

We maintain applicable technical and organisational measures to protect your personal data against unintentional, unlawful or unauthorised deletion, loss, change, disclosure and/or use. We have especially implemented the following measures to protect your personal data’s confidentiality, integrity and accessibility, including but not limited to:

• Encryption and anonymisation if possible/needed;
• Guidelines and processes to assure Gibson Medical’s employees secure access to personal data;
• Education and training to make sure that all personnel are aware of the applicable security requirements;
• Choice of suitable data processors, and if applicable sub-processors, that can prove their compliance with applicable laws and regulations on data privacy;
• Thorough review of data processors, processes and procedures and, if necessary, update of procedures and/or renegotiation of terms/instructions to the processors.

How we might disclose your data

We do not disclose your personal data to any third party and we never sell you information. The access to your personal data within Gibson Medical are limited to the employees, consultants or advisers who need access to the data to fulfil their assignments. The employees, consultants and/or advisors are governed by strict requirements on confidentiality in agreements and can be subject to disciplinary measures or dismissal if they are not abiding with the requirements.

International transfer of your personal data

Gibson Medical strive to always process your personal data within the EU/EES. If your personal data would come to be processed outside the EU/EES by one of our service providers, we make sure that there are appropriate security measures in place so that the processor is processing the personal data in the same secure manner as we do, e.g. by having a data processing agreements that include the standard clauses as recommended by the EU commission in place.

Your rights

If Gibson Medical processes your personal data, you are entitled a number of rights by the GDPR that you can exercise by sending a request to us. Your rights as a data subject (i.e. person whose personal data we process) provide you the possibility to request us to:

• Provide you with an extract with your personal data as processed by Gibson Medical.
• Rectify of personal data that is wrong.
• Delete your personal data (also called right to be forgotten).
• Limit the processing of your personal data.
• Transfer of your personal data to another party (the right to portability).
• Cease to process your personal data (right to object)
• Not perform automated individual decision-making by use of your personal data.
